End User License Agreement

Contents
This End User License Agreement is between you and AnzenApp, the publisher of the Anzen apps. The legal entity is [TODO: owner to confirm legal entity name, e.g. AnzenApp LLC]. If you do not agree, do not install or use Anzen.
These terms are written for the owner’s review. They are not legal advice.
License grant, scope, and restrictions
AnzenApp gives you a personal, non-exclusive, non-transferable, revocable license to install and use the Anzen client on devices you own or control, for chat with other Anzen users. The license covers the TestFlight and Google Play testing builds, and later desktop builds if they are offered.
You do not receive the source code, the server software, or any right to the Anzen name or marks. You may not:
- Copy the app except as needed to install it, or sell, rent, or sublicense it
- Reverse engineer it except where a law says that limit does not apply
- Use it to break encryption, accounts, or calls that are not yours
- Remove notices in the app
- Use it to operate a competing service or to resell access
The API, the database, and the message store stay with AnzenApp. Using them is allowed only through the app, under this agreement.
Accounts
Anzen has no password. You sign in with an email code, then an authenticator app or a passkey. A new device needs both. You choose a device PIN, and you can change it with Change device PIN. A phone may also unlock with Face ID or a fingerprint.
You are responsible for the email account, the authenticator or passkey, the PIN, and the recovery key. AnzenApp cannot restore history if the recovery key is lost. Resetting the account key makes older history unreadable on purpose. You are responsible for activity on your account until you revoke the device.
Acceptable use
Do not use Anzen to break the law, to attack the service, or to harm people. In particular, do not:
- Upload, store, or send illegal content
- Upload, store, or send child sexual abuse material, or any sexual content involving a minor
- Attempt to break encryption, accounts, or voice sessions that are not yours
- Overload the API, the mail sender, or a voice relay
- Upload malware in place of a file you mean to share
- Abuse invite limits or send unsolicited invites
Workspace owners and admins decide who may stay in a workspace they control. The app enforces those roles. AnzenApp does not read message contents to moderate them, because the server stores ciphertext. We may suspend an account or a device when we have to in order to protect people or the service, including when the law requires it.
Your content
You keep whatever rights you have in what you send. You give AnzenApp a license only to store and transmit the encrypted form, and the account data needed to run the service, so the service can function. That license ends when the content is deleted from the service, except for copies that remain in backups for the time those backups are kept. Because messages are end-to-end encrypted, AnzenApp cannot license the readable text to anyone else.
Plans
Every account starts on Free. Limits come from the API:

Plus is not for sale yet. Paid terms, including the price, taxes, renewal, and refunds, will be added when billing launches. Do not treat “Coming soon” as an offer to sell Plus at any price. A development upgrade switch is not a purchase, and it is off unless the server is explicitly configured to allow it.
Workspace and voice limits follow the workspace owner’s plan. Upload size follows the sender. History you can scroll follows your plan, and messages sent by Free accounts are deleted after 30 days.
Beta and TestFlight builds
The iOS build is offered through Apple TestFlight. The Android build is offered through Google Play testing. Both can change, break, or be withdrawn. Voice quality depends on the network between the people in the call. Desktop downloads are not offered yet.
Test software may lose data. Keep your recovery key somewhere you control. Do not rely on a test build as your only copy of anything you cannot lose.
Updates
Apple or Google may deliver a new build through TestFlight or Play testing. The API does not currently refuse an older client by version number. A future build may be required to keep signing in if a security fix cannot be done any other way. [TODO: owner to confirm whether a minimum app version will be enforced]
Termination
You may stop using Anzen at any time by signing out and removing the app. You can remove a device, which ends that device’s session and deletes its push token. The app has no control that deletes the whole account. [TODO: owner to confirm how someone asks for an account to be deleted, because the app has no delete-account control]
AnzenApp may suspend or end access if you break this agreement, if the law requires it, or if the test ends. Encryption does not stop us from closing an account. It does stop us from reading the messages in order to do that. Sections that should survive ending, including ownership, disclaimers, liability, and disputes, still apply.
Export control, sanctions, and encryption
Anzen includes encryption: quantum-proof encryption (ML-KEM-1024) and authenticated encryption (AES-256-GCM) for messages, and encrypted call audio (DTLS-SRTP) for voice. You may not download or use Anzen if you are in a country or on a list that US sanctions or export law forbids, or if you are using it for a prohibited end use. Third-party components and open-source notices
The phone app is built with Flutter and open-source libraries, including packages for encryption, WebRTC, and, when push is compiled in, Firebase Cloud Messaging. The API is written in Go. Those components stay under their own licenses. Your license to Anzen does not replace those licenses. [TODO: owner to confirm a published open-source notices file]

Disclaimers
Anzen is provided “as is” and “as available,” especially while it is in testing. AnzenApp disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent the law allows.
Encryption reduces who can read a message. It does not make a lost phone, a shared PIN, a lost recovery key, or a compromised device safe. Voice setup is not end-to-end encrypted. A 30-digit privacy code is how two people check that nothing is sitting between them.
Some places do not allow a disclaimer of certain warranties. In those places, the disclaimer applies only as far as the law allows.
Limitation of liability
To the extent the law allows, AnzenApp is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost messages, lost profits, or lost data. AnzenApp’s total liability for a claim about the service is limited to the amount you paid AnzenApp for Anzen in the 12 months before the claim. While Plus is not for sale, that amount is zero. This limit does not apply where the law forbids it, including liability that cannot be limited for death, personal injury, or fraud.
Indemnity
You will defend and indemnify AnzenApp against claims, losses, and reasonable expenses that come from your content, your misuse of Anzen, or your breaking this agreement or the law, including a claim about illegal content or child sexual abuse material you send. AnzenApp will give you notice of the claim when it is practical.
Governing law
The law of the State of Texas, USA, governs this agreement, without regard to conflict-of-law rules. This choice does not take away rights that a consumer-protection law in your place of residence says cannot be waived.
Disputes
Contact us first and give us a short description of the dispute. If we cannot resolve it, either of us may bring the dispute in the state or federal courts located in Texas, and you consent to that venue. [TODO: owner to confirm the county, for example Travis County]
Nothing here requires arbitration. If you downloaded Anzen from Apple, the Apple terms below also give Apple a right to enforce that section.
Changes
We may update this agreement by posting a new version on this page and changing the effective date. If you keep using Anzen after the effective date, you are agreeing to the updated terms. Apple App Store terms
If you downloaded Anzen from the Apple App Store or TestFlight, the following also applies, as Apple requires. If these sentences conflict with the rest of this agreement, these sentences win for an Apple download.
- This agreement is between you and AnzenApp only, not with Apple. Apple is not responsible for Anzen or its content.
- The license is limited to a non-transferable use on Apple-branded products that you own or control, as Apple’s usage rules allow.
- AnzenApp is solely responsible for maintenance and support. Apple has no obligation to provide maintenance or support for Anzen.
- If Anzen fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation. Any other claim, loss, liability, or cost from a failure to conform is AnzenApp’s responsibility. The test builds currently have no purchase price.
- AnzenApp, not Apple, is responsible for product claims, including product-liability claims, legal or regulatory claims, and consumer-protection claims.
- AnzenApp, not Apple, is responsible for investigating and defending intellectual-property claims about Anzen, and for settling them.
- AnzenApp’s contact for questions and claims is
[TODO: contact email]and[TODO: mailing address]. - You represent that you are not in a country subject to a US government embargo or designated as a terrorist-supporting country, and that you are not on a US government list of prohibited or restricted parties.
- You must comply with third-party terms when you use Anzen, for example your wireless-data agreement.
- Apple and Apple’s subsidiaries are third-party beneficiaries of this Apple section, and they may enforce it against you.
Google Play terms
If you downloaded Anzen from Google Play, the following also applies.
- This agreement is between you and AnzenApp only, not with Google. Google is not responsible for Anzen, its content, or its support.
- AnzenApp is responsible for maintenance, support, product claims, and intellectual-property claims about the app.
- Google Play’s own terms also apply to the download and to the Google account you use. If those terms conflict with this agreement about the store relationship, Google’s terms win for that relationship.
- Google is a third-party beneficiary of this Google Play section only to the extent Google’s terms require it, and may enforce that part.
